Article 3 – Applicability

These Terms & Conditions apply to all offers made by Fashionistia and to all distance contracts and orders concluded between Fashionistia and consumers.

Before a distance contract is concluded, these Terms & Conditions will be made available to the consumer. Where reasonably possible, they will be provided electronically in a format that can be stored for future reference.

If specific product or service conditions apply in addition to these Terms & Conditions, the consumer may rely on the provision most favorable to them in the event of conflicting terms.

If any provision is found to be invalid or unenforceable, the remaining provisions will remain effective to the extent permitted by applicable law.

Nothing in these Terms & Conditions limits any mandatory statutory consumer rights.

Article 4 – Products and Offers

All offers are subject to availability and any conditions expressly stated in the offer.

Fashionistia aims to provide complete and accurate descriptions of its products, including relevant characteristics, sizes, colors, and materials.

Product images are intended to represent the items as accurately as possible. However, colors may vary slightly depending on screen settings and lighting conditions.

Obvious typographical or pricing errors may be corrected, subject to applicable consumer protection laws.

Before completing an order, customers will be informed of the total price, applicable shipping charges, available payment methods, and relevant delivery information.

Any additional import duties, taxes, or customs charges will be disclosed where required by applicable law.

Article 5 – Formation of the Contract

A contract is formed when the consumer accepts an offer and the applicable conditions for completing the purchase have been satisfied.

After placing an order, the consumer will receive an electronic confirmation acknowledging receipt of the order.

Fashionistia uses appropriate technical and organizational measures to protect electronic transactions and customer information.

Fashionistia may refuse or cancel an order for legitimate reasons, including product unavailability, suspected fraud, or payment issues, subject to applicable law.

Orders are subject to product availability. If an item becomes unavailable after an order has been placed, the customer will be informed and offered an appropriate solution, including a refund where required.

Article 6 – Right of Withdrawal

Consumers covered by applicable EU consumer protection legislation generally have the right to withdraw from an online purchase within 14 days without providing a reason.

The withdrawal period begins on the day after the consumer, or a designated third party other than the carrier, receives the goods.

To exercise this right, the consumer must notify Fashionistia of their decision to withdraw before the withdrawal period expires.

Withdrawal requests may be submitted by email to info@fashionistia.com.

After notifying Fashionistia of the withdrawal, the consumer must return the goods within 14 days.

During the withdrawal period, consumers may inspect and try on products to the extent necessary to establish their nature, characteristics, and functioning, as they would in a physical store.

Consumers may be responsible for any diminished value resulting from handling beyond what is necessary for this purpose.

Article 7 – Return Costs and Refunds

Where the consumer exercises their statutory right of withdrawal, direct return shipping costs are borne by the consumer, provided this was communicated before purchase and unless applicable law requires otherwise.

Fashionistia will reimburse the payments required by applicable law, including standard outbound delivery costs where applicable, within 14 days after being informed of the consumer's decision to withdraw.

Fashionistia may withhold reimbursement until the returned goods have been received or the consumer has provided evidence of having sent them back, whichever occurs first.

Refunds will be issued using the original payment method unless otherwise expressly agreed with the consumer.

No additional refund fees will be charged for statutory withdrawals.

Article 8 – Exceptions to the Right of Withdrawal

The right of withdrawal may not apply to certain products where an exception is permitted by applicable law, including:

  • Products made to the consumer's specifications or clearly personalized.
  • Goods that deteriorate or expire rapidly.
  • Sealed goods unsuitable for return due to health protection or hygiene reasons, once unsealed after delivery.
  • Other products expressly exempted under applicable consumer protection legislation.

Any applicable exception will be communicated before the purchase is completed.

These exceptions do not remove statutory rights relating to defective or non-conforming products.

Article 9 – Prices

All product prices are displayed on the Fashionistia website in the currency selected or shown at checkout.

The total price payable, including applicable taxes and shipping charges, will be presented before the customer completes their purchase.

Any customs duties or import-related charges will be handled in accordance with the information provided at checkout and applicable law.

Fashionistia reserves the right to update product prices and promotional offers. Price changes will not affect confirmed orders except where legally permitted.

In the event of an obvious pricing error, Fashionistia will contact the customer and handle the order in accordance with applicable consumer protection laws.

Article 10 – Product Conformity and Warranty

Fashionistia is committed to supplying products that conform to their descriptions and meet applicable legal requirements.

Customers retain all statutory rights concerning defective, damaged, or non-conforming goods.

Any commercial warranty offered by Fashionistia, a manufacturer, or another provider is additional to, and does not replace or limit, statutory consumer rights.

If a product arrives damaged, defective, or incorrect, customers are encouraged to contact info@fashionistia.com with their order details and supporting photographs.

Where legally required, Fashionistia will provide an appropriate remedy, such as repair, replacement, price reduction, or refund.

Article 11 – Shipping and Delivery

Fashionistia takes reasonable care when processing and fulfilling customer orders.

Orders will be delivered within the agreed delivery period or, where applicable law provides and no different period has been agreed, within 30 days after the contract is concluded.

If delivery is delayed, the customer will be informed where reasonably possible.

If Fashionistia cannot fulfill an order, the customer will be offered an appropriate resolution, including reimbursement where required by law.

The risk of loss or damage generally remains with Fashionistia until the goods are physically received by the consumer or a third party designated by the consumer, other than the carrier, subject to applicable legal exceptions.

Article 12 – Continuing Contracts, Cancellation and Renewal

Where Fashionistia offers continuing contracts or subscription-based services, the duration, renewal conditions, and cancellation procedures will be communicated before the contract is concluded.

Consumers may terminate such contracts in accordance with the agreed conditions and applicable mandatory consumer protection laws.

Any automatic renewal provisions will be subject to applicable legal requirements.

Article 13 – Payments

Customers must pay the total amount shown at checkout using one of the available payment methods.

Payment processing is carried out through the payment providers available on the Fashionistia website.

Customers are responsible for providing accurate payment and billing information.

If a payment cannot be completed or is declined, the order may remain unprocessed until payment is successfully received.

Any charges arising from late payment will be subject to applicable law and must be disclosed where required.

Article 14 – Complaints and Customer Support

Fashionistia aims to handle customer complaints fairly, professionally, and efficiently.

Customers may submit complaints by contacting info@fashionistia.com.

Please include your order number, a clear description of the issue, and any relevant supporting information.

We aim to respond to complaints within 14 days of receipt. If additional time is required, we will inform the customer of the expected response timeframe.

Where a complaint is justified, Fashionistia will provide an appropriate solution in accordance with applicable consumer protection laws.

Customers retain their statutory rights regardless of when they contact us, subject to applicable legal limitation periods.

Article 15 – Governing Law and Disputes

These Terms & Conditions are governed by Dutch law, without prejudice to any mandatory consumer protection provisions applicable in the consumer's country of habitual residence.

Nothing in these Terms & Conditions deprives consumers of protections that cannot be excluded by agreement under applicable law.

In the event of a dispute, customers are encouraged to contact Fashionistia first so that an amicable resolution can be explored.

Any legal proceedings or dispute resolution procedures will be subject to applicable jurisdiction and consumer protection rules.
